Countrywide Observation of the Implementation of the International Fair Trial Standards in Domestic Courts and Assessment of the Functioning of the Judiciary

Period of implementation: June, 2003 - December, 2004

Key objectives

  • to increase the confidence of the citizens in the legal system and judiciary
  • to identify the problems in the judicial system
  • to indicate the need of legal and institutional reforms
  • to increase the respect of the standards of fair trial s in the domestic courts
  • to get acquainted the public with the fair trial standards

  • Preparation of Trial observation manual (in co-operation with experts from the law faculty of Justinian I University in Skopje, the law faculty of SEE University in Tetovo and the Macedonian Bar Association, a pilot version of a trial observation manual was produced)
  • Training sessions on the theoretical and practical aspects of trial observation more>>>
    Monitoring of the court trials
  • Observation of court proceedings
  • Preparation of Interim report (based on the information gathered from the questionnaires in a period from July 2003 until January 2004, as well as data from monthly reports of the local coordinators and reports of the local legal experts, interim report of the coalition has been created)
  • Round table
  • Preparation of Final report that presents data gathered in the monitoring process, for implementation of each international standard in both, criminal and civil procedure. In addition, a comparative analysis of the domestic legislative, legislative of the other countries and of international law is done.
