Observation of the judicial cases of the criminal acts against the elections and the voting

 

Within the project court trials against the perpetrators of the criminal acts against election and voting committed during the Local election, 2005 are observed in all Basic courts in the Republic of Macedonia.

The courts trials are observed by 6 monitors who fill questionnaire for each trial and submit it to the national office. All the collected data about the criminal persecution of the persons who during the elections committed criminal acts against the elections and the voting were systemized and analyzed, so based on the systematization and analysis of the same Final report has been prepared.

Regarding the submitters of the criminal charges, the data analysis, showed that of a total of 20 criminal charges against 65 perpetrators, 14 criminal charges are brought by the Ministry of internal affairs, 4 criminal charges are brought by citizens, and 2 criminal charges are brought by the Association of the Roma people of RM .

Before the Basic court Kumanovo, Prilep, Strumica and Skopje I, there are 4 ongoing trials against 12 persons accused for criminal acts against the elections and voting.

Regarding the criminal sanctions, the persons who have been found guilty have been pronounced three types of sanctions: penalties (imprisonment and a fine); alternative measures (conditional verdict-parole) and correctional measure (enhanced supervision by the parents under control of a social body).

Penalty-prison has been pronounced to 11 persons, 7 persons are fined, to 7 persons a conditional verdict is pronounced, and to one person – minor, a correctional measure (enhanced supervision by the parents under control of a social body) was pronounced.
