Basic human rights in contacts with the police

 

 

Prohibition of torture

 

None shall be subjected to torture, inhuman or humiliate behavior or punishment

 

Right to freedom and safety

 

None can be deprived of freedom, except in a law procedure

 

Everyone who is deprived of freedom by authorized officials of the Ministry of interior must be immediately or at the most 24 hours from his deprivation be brought to competent investigate judge.

 

Anyone who is apprehended or arrested, must immediately be informed, in the language which he understands, of the reasons for his apprehension or arrest and of any charge against him, as well as about his rights and that he cannot be compelled to make a statement.

 

Minimum rights for persons deprived of freedom

 

•  right to remain silent

•  right to chose a lawyer

•  rights for appropriate medical treatment

•  right to be informed member of his family or other close person in a period of 24 hours

 

The person unlawful deprived of freedom, detained or unlawful tried has a right for compensation of damage

 

Based on a warrant, during search of premises or persons, the authorised officials from the Ministry of interior can temporarily confiscated only those objects and identity cards which are in connection with the aim of the search in that particular case.

 

 

 

If there is no reasons for their confiscation, or if the criminal procedure is stopped, the temporarily confiscated objects and identity cards will be brought back to the owner
