This is your rights- in court procedure:

     

•  The right to equality in court and law

Laws must not be discriminatory, and that judges and officials must not act in a discriminatory fashion in enforcing the law, everyone have a right of equality before the courts

 

•  The right to a trial before a competent, independent, impartial and by law established court

Political institutions do not reach decisions, but competent, independent and impartial courts established by laws.

 

•  The right to a fair trial

Everyone has a right to a fair trial, and equal arms for prosecution and defense.

 

•  The right to public trial

The right to a public hearing means that not only the parties in the case, but also the general public, have the right to be present.

 

•  Presumption of innocence

Each individual charged with a criminal act is presumed innocent unless proven guilty in accordance with law.

 

•  The right to remain silence

Each individual charged with a criminal act has a right to remain silence during the investigation as well as during the trial.

 

•  The right of a trial in reasonable time

Each individual charged with a criminal act, the plaintiff and the defendant have a right to a trial in reasonable time without undue delay of the procedure i.e. proceedings must be started and completed within a reasonable time.

 

•  Prohibition of retroactive impact of laws

The laws could not have retroactive impact, except in the cases when this is in advantage for the person charged with a criminal act.

 

•  The right to be informed about the charges

Every individual charged with a criminal act has a right to be informed, in the shortest period of time, in detail and in the language he/she understand, about the nature and reasons for the indictment against him/her.

 

•  The right of a sufficient time and possibility to prepare the defense

Every individual charged with a criminal act, the plaintiff and the defendant have a right of a sufficient time and possibility to prepare the defense in all stages of the procedure

 

•  The right to defense

Every individual charged with a criminal act, the plaintiff and the defendant have a right to defend himself/herself or use a defender he/she has chosen.

 

 

•  The right to call and examine new witnesses for interrogation

Every individual charged with a criminal act, the plaintiff and the defendant have a right to call and examine new witnesses for interrogation on their behalf.

 

•  The right to an interpreter and to translation

Every individual charged with a criminal act, the plaintiff and the defendant have the right to the assistance of a competent interpreter, free of charge, if they do not understand or speak the language used in court.

 

•  The right to appeal

Everyone convicted of a crime, the plaintiff and the defendant shall have the right to appeal to his conviction and sentence being reviewed by a higher tribunal according to law.
