Training on article 6 from European Convention on human rights

 

 

In order to increase the level of knowledge of a selected number of observers which will consequently lead to an increased quality of gathered information, as well as to increase the level of knowledge of a legal experts, local and National one, involved into the creation of the final report, advanced training on art.6 of the ECHR have been organized on 17, 18 of May 2004 by he Coalition “All for Fair Trials” , OSCE and Council of Europe .

 

Training have started with opening session facilitated by Mr. Trajce Pelivanov, Mr. Simon Greuter, Rule of Law project officer and Ms. Hanne Juncher, Resident expert of the Council of Europe. All of them have support the idea of increasing the knowledge about different fair trials standards and international protection mechanism as a factor that can contribute for providing the better quality of the results of the observations made in all basic courts in Macedonia and at the same time better impact in direction of increasing the respect of this standards in domestic courts.

 

Introduction to the ECHR and its main principles as well as information's regarding the right to an effective remedy before a national Authority, have been presented by the expert Ms. Deirdre Fottrell , Lecturer in Law, Department in Law from University of Essex .

 

Introduction to the right to a fair trial under the Article 6 of the ECHR have been done by the Mr. Lischina , lawyer at the ECtHR from Ukraine.

 

Both experts have explained the importance of this document for the Human rights and fundamental freedoms situation in European countries. They have explained the meaning of every article of the ECHR following the conclusions with lot examples from the practice.

 

After the in-depth interpretation of what civil rights and obligations incorporates and what is the meaning of the criminal charge, the attention of the participants have been focus on Right to a fair trial under the Article 6 of the ECHR

 

Special value in the presentation of all standards individually has been a loot of examples from the practice of the EC.

 

Introduction to the ECtHR and the rule of the court have been done by the M. Ivan Lishina.He have presented the structure of the EC (Committees, Chambers and Grant Chamber ), jurisdiction, powers, decisions making process. Also in detailed have been explained the adminissibility criteria, individual applications, Inter-state cases etc.

 

Macedonian cases before the ECtHR ( related to the article 6) have been presented by Ms. Radica Gerovska , government agent representing the State at the ECtHR. She have prepare statistical overview of the cases (number and type, period as well as the verdicts made), and she have also presented the proposed changes in civil procedure code on which she have been involved.

 

For the training two exercises for the participants have been prepared and facilitated. Three groups of participants, according to their role, have played and actively contributed to the more successful implementation of the training.

 

The training has ended with certificate giving ceremony.

 

On 17th of May a press release with the information's regarding the article 6 training have been send in public by OSCE.

 

This training have been a great opportunity for exchanging the experience regarding the implementation of the international fair trials standards in domestic courts between the different actors in the monitoring process (observers, coordinators, local experts, legal analyst and Management team) as well as great opportunities to increase the knowledge regarding functioning of the ECtHR and practices from implementation of the article6 of ECHR.
