On 27 and 28 May, 2008, a Training for the European Court of human rights was held and legal advisors of the Human Rights Support Project took participation : Mihail Gotovski from the Coalition “ All for Fair Trails”, Boris Gudev from “ Choice” , Talia Baboska from the” Center for Civil Initiatives” , Bekim Nuhija from the Center of Democratic Development, Feat Kamberovski from Forum of the rights of Roma- Arka, as well as the Project Coordinator of the Human Rights Support Project, Anica Tomshic Stojkovska.
On 27.05.2008, a lecture was given by the M. Sc Ilina Cenevska - Assistant at the Faculty of Law in Skopje and she gave an explanation for the Convention of human rights at which the Court of Strasburg is based on, the way of functioning of the European Court, permission in decision-making as well as an obligation of the states in the part of respecting the decisions and verdicts by the Court.

On 28.05.2008, the lawyer Trajce Todorov from Shtip gave a lecture on the procedure of applying, the way of filling in the application, the possibility of free legal help at the Court of Strasbourg as well as giving a special attention to the cases referring article 3 from the Convention which includes the acts of torture and other inhuman and cruel behavior.

On 06.05.2008, the Project coordinator Anica Tomshic Stojkovska attended the tribune “ European story is different for Macedonia.” organized by FOSIM , at which was involved in the same discussion about the effectiveness of the Law of Police. vaga Conclusions reached by the participants at the round table referring the rule-book - 31.05.2007


On 28.05.2007 associations of citizens – Arka, Choice, CDR, CGI and the Coalition All for fair trials, partners in the Human Rights Support Project organized a round table in the hotel Continental in Skopje. The same was organized on the occasion of making a new rule-book on the actions of the Sector for internal control and professional standards.
Moderator was the President of Arka, Mr. Feat Kamberovski.

The opening statement was given by Mr. Viktor Ulom, Head of the Rule of law department in the Mission of OSCE in Skopje.
Mr. Voislav Zafirovski, Assistant of the Minister in the Ministry of Internal Affairs, Head of Sector for internal control gave a lecture for the new items in the rule book on the activities of the Sector for Internal control and professional standards, Mr. Petar Jordanoski from the HRSP gave a presentation on the position and the functioning of the Internal Control Sector in Republic of Serbia, Prof. Dr. Trpe Stojanovski, Assistant Minister in the Ministry of Internal Affairs, professor at the Police Academy , for Types of control over the police – comparative review and MR. Tripun Tanusheski, Deputy Ombudsman for the Relation between the Ombudsman and the Internal Control Sector and professional standards from the aspect of the New rule book.

Participants were the legal advisors of HRSP, the deputies of the ombudsman from the office in Skopje and the terrain offices around Macedonia, detached inspectors of Sector for internal control , professors from the Faculty of Law in Skopje, and the Police academy, representative from UNDP and representatives from OSCE.

As a result of the presentation there can be given several conclusions from the participants of the round table:

  • There is a need of change of the Internal affairs law and the Collective agreement in order to predict other disciplinary measures of sanctioning the Officials in MoI in the cases of police abuse, besides already existing – notice of dismissal and fine. The representatives of Sector agree with the statements of the civil sector that there is a discrepancy between the violations of the rights of the citizens by police officers in MoI and the already definite sanctions and they think that the resolution is being changed and added from the previously mentioned acts
  • In 2006, and especially in 2007, in contrast to the previous years, Sector in most of the cases respects the determined deadlines when answers should be given to the ombudsman, the associations of citizens and the citizens which turned to Sector or the police
  • The regulation of article 17, item 3 which stipulates that the procedure of Sector for the written submission can last even six months and leaves the possibility of playing out the justice. Namely, the deadline of six months is predicted especially for statements of committed crime by OSL in MoI , and on the contrary the Labour Relations Law prevents any kind of disciplinary measure if there has been more than 6 months since the incriminated act. So the conclusion is that any deadline longer than 3 months leaves the possibility of abuses by the employees in MoI , violating the human rights.
  • The provision of the new rule book for doing the work of Sector is greeted and predicts responsibility of the Head that knew or had an obligation to know about violation of the working order and discipline or other unlawful action of Police officers in MoI and did not take appropriate measures.
  • In the new rulebook for the activities of Sector, as in the old one there is no regulation with which the alleged victim of police abuse would be given legal advise how to protect his rights in front of other authorized bodies.
  • There is a need of more detailed elaboration of the article 16 which regulates the action after anonymous complains by citizens. The way that is conceptualized leaves the possibility of arbitration by detached inspectors of Sector when the decision is brought whether they are going to act according the same procedure. Anonymous complains most often are result of the fear of the citizens of conflict with Officers in MOI, and on the contrary they can consist confirmed data for serious violation of human freedom and rights by Officers .
  • There is a need of explaining the term ” freeing ” in article 20, item 3, point 3 from the Rule book as well as reviewing the possibility of complete withdrawal of point 2 of the same article, in which the conclusions of the final report can claim that there are not enough proofs for illegal and unprofessional behavior of Officers in MoI. There is no such regulation in the procedure in front of the public prosecution.
  • There is a need of precising the relationship between Sector and MoI from one and the Ombudsman office from the other side. On the contrary the future cooperation will be determined by the personal solutions of these institutions. In this direction, there is a need of more aggressive and proactive presentation by the representatives of the Office of the Public Attorney in the treatment of the cases of police abuse, according to their lawful authorities, not to be able to meet Officers in MoI for which there are indications that they have violated the human rights only because it is about members of special police forces.

 

vaga Training for the procedure of the Public prosecutor’s office in the registered cases of police abuse - 30.05.2007


On 12.05.2007 in the hotel Arka in Skopje, a training was held for the procedure in front of the Public prosecutor’s office.
Moderator was the Project Coordinator of HRSP, Petar Jordanoski, who had an opening address for the Action of Public prosecution in the cases of police abuse in the frames of HRSP and the cases of police abuse.

MS. Gordana Geshkovska, Deputy Prosecutor and president of the Associations of public prosecutors gave a lecture on the Role and the action of Public prosecutor’s office in the cases of police abuse, and the lawyer Filip Medarski gave a lecture on the Legal means that the victim can use and their lawyer in the cases of police abuse.
Participants were the legal advisers of HRSP and their deputies, representatives of FOSIM and Prof. Gordan Kalajdgiev from the Faculty of Law in Skopje.

 

Press conference - 21.12.2005


ARKA, CDD, Coalition “All for Fair Trials”, Choice and CCI, implementing partners in the Human Rights Supporting Project held Press conference on 21 of December 2005 starting in 11 o'clock in Holiday Inn in Skopje.

Main purpose of the press conference was presentation of the report for the period 2004 and 2005 and recommendation and conclusion's regarding the cases of alleged misconduct or mistreatment of the police officers in Macedonia . Besides representatives from NGO's in the frame of the HRS Project also Mr. Andrew Palmer , program director of the OSCE Spillover Mission in Skopje , has participated at the same.

 

 

Participation on the NGO Fair - 5 Forum of the civil society


Coalition “All for Fair Trials” has participated at the Ngo Fair that took place from 9 to 11 December 2005 in Skopje . Since the establishment this is the Coalition second participation at the Fair on which the public could inform with the Coalition's activities and especially published materials.

 

 

Press conference 09.12.2005


Promotion of the report "Combating Trafficking in Human Beings through the practice of domestic Courts" was held in Hotel “ARKA” on 09.12. 2005.

Executive director of the Coalition Ms. Vesna Stojkovska has presented the activities in the frame of the project “Observation of Trafficking in Human Beings related Trials.”

Project Coordinator, Ms. Violeta Velkoska has presented the conclusions and recommendations from the report of the Coalition “All for Fair Trials.”

Deputy of the ambassador of the OSCE Mission in Skopje has supported the activities against the Trafficking in Human Beings in Macedonia as well as activities of the Coalition “All for Fair Trials.”

 

 

Promotion of the activities of the Coalition


In the period from November 24 th until December 10 th , the Coalition “All for Fair Trials” held 9 local coordinative meetings in order to present the undertaken activities, as well as the conclusions and recommendations set forth in the Final report.

Representatives from the judiciary, the local authorities, and media were presented at the following meetings:

  1. 24.11.2004 - in the Centre for support of the NGO's in Stip ;
  2. 25.11.2004 - in the City council in Bitola ;
  3. 27.11.2004 - in the Centre for support of the NGO's in Veles;
  4. 29.11.2004 - in the Centre for support of the NGO's in Strumica;
  5. 30.11.2004 - in the City council in Tetovo;
  6. 1.12.2004 - in the Centre for support of the NGO's in Prilep;
  7. 2.12.2004 - in the City council in Kavadarci;
  8. 8.12.2004 - in the municipality in Kumanovo;
  9. 10.12.2004 - in the Primary school “Hristo Uzunov” in Ohrid.

 

 

Strategic planning


After a year of the Coalition's work on the project “ Countrywide Observation of the Implementation of International Fair Trials Standards at Domestic Courts and Assessment of the Functioning of the Judiciary in Macedonia ” the Coalition's leadership turned towards the process of strategic planning for the next 5 years.

It started with a strategic planning workshop (3rd to 5th June 2004, in Bitola ) designed to enable interactive analysis of the conditions inside the organisation with the help of the SWOT analysis, IOM , Minceberg matrix, and of the immediate environment with the tools: institutional diagram, environment scanning and SWOT matrix. Coalition representatives from all structure levels were present at the workshop.

After the preparation of a draft report on the workshop conclusions, on 14th June, 2004 , in accordance with the determined plan for taking further steps in the process of strategic planning, a joint gathering of the local coordinators and members of the Executive Board was held. After the acceptance of the Final Report of the workshop with set conclusions for further development of the Coalition, meetings between the observers and local coordinators at a regional level were organised to enable observers' maximum involvement in the process of creation of development policies.

The President of the Coalition Mr. Trajce Pelivanov, the Executive Manager Miss. Violeta Velkoska, the Vice-president Miss. Vesna Stojkovska and the Legal analyst Miss. Jasna Cvetkovska took part in the preparation of the draft strategic document in the last 5 years.

 

 

Evaluation of the project


In order to obtain a high-quality and impartial evaluation of the Coalition's achievements supported by the OSCE's Mission in Skopje , OSCE/ ODIHR ordered a preparation of a thorough assessment .

After a large number of meetings with subjects from the Coalition, as well as with those who are not its members, i.e. representatives of the judiciary, the National Judicial Council, the Ministry of Justice, the media and after a detailed analysis of the materials/documents received as a result of the Coalition's work, Mr. Lukaz Bojarski and his team prepared an evaluation report during 16th-21st May 2004. This report prepared by the Coalition served as a high-quality tool in the process of planning of the future development.

 

 

Interim report


On 10.05.2004 in Hotel “Jadran” the promotion of the “Interim report” has been hold. Executive director of the Coalition Violeta Velkoska have presented the first findings about the level of implementation and respect of the international fair trials standards in domestic courts as well as recommendations of the experts how to increase the functionality and efficiency of the judiciary

Beside Prof. Ljupco Arnaudovski and Judge Ranko Maksimovski which have presented some specific issues in criminal and civil procedure, Ambassador Carlos Pais , Head of the OSCE Spillover Monitor Mission to Skopje have spoken about the judiciary reforms as a crucial and necessary step for joining in the EU .

Results of the Interim report have been published on 11.05.2004 in “Makedonija Denes” newspaper, in “Vecer”, “Vest”,”Fakti” as well as in “Utrinski vesnik”. Interim report>>>

 

 

Training for the local coordinators


On 05.04.2004 in the National office of the Coalition one-day training for the local coordinators by Mr. Simon Greuter and Ms. Violeta Velkoska has been organized.They discussed about some issues such as: contact with the judiciary, case selection, system of control of observers, monthly reporting, communication in the frame of NGO's and improving the profile of the Coalition's members .

 

 

Study Visit to Kosovo


In order to strength the management capacities of the NGO Coalition “All for Fair Trials” and increase the knowledge on existing trial monitoring systems of the leading actors of the NGO Coalition “All for Fair Trials”, on 24-26 January 2004 , visit to the Legal System Monitoring Section (LSMS) of the OSCE Mission in Kosovo has been organized based on the initiative of Rule of Law Project Officer, Mr. Simon Greuter ….. more>>>

 

 

High profile cases


On the Board meeting of the Coalition “All for fair trials”, hold on 22.12.2003 , following cases have been chosen as a “high profile” cases:

  1. Case ”Negotino Gymnasium”-Veles (criminal case)
  2. Case ” Tetovo Tabak ”-Tetovo (civil case)
  3. Case “ Amdi Bajram ”-Stip (criminal case)
  4. Case “Lozar”- Bitola (civil case)
  5. Case “ Lambe Arnaudov ” (criminal case)

 

Situation with this cases have been continuously followed. Special observers have been chosen for observing the hearings and materials from newspapers have been collected.

Trial observation manual


Promotion of the trial observation manual prepared by the team of legal experts was held in Hotel “Jadran”on 19th of December 2003 . In front of a lot of media representatives and also guests, Mr. Arnaudovski Ljupco as a senior spoken person has presented the contents of the manual. Additionally words of support have been given from Mr. Simon Greuter , Project Officer from OSCE Rule of Law Department and Mr. Habib Massoud , Head of Canadian Office in Skopje .

On 20/21 of December in “Utrinski vesnik” text regarding the content and purpose of the Manual have been published.

First press conference


Public presentation of the Project and Coalition activities has been made on the first press conference on the 18.11.2003 in “Holliday Inn”.

Mrs. Jagoda Gligorovska , member of the Program Board, has presented the Coalition, Structure, Project goal and Activities.

Ambassador of OSCE in Macedonia Mr. Craig Jenness , has express support to the Project with his unselfish contribution on the conference. Advisor of the Coalition, as well as Project Officer in the OSCE Department Mr. Simon Greuter, have spoken about future plans and activities of the Coalition and ongoing Project.

In newspaper “Dnevnik”, on 19 th of November very detailed material regarding the role of the Coalition, implemented project activities as well as planed one, have been published.
